Terms and conditions

I. General: These terms and conditions apply to all that SHOETATION - Harald Lex (only SHOETATION used in this text) will be completed with the following.

The terms and conditions apply to the sale and supply of goods by SHOETATION. Different conditions of the buyer are only valid if we have approved them in writing or company signature. By checking the box before the order  "I have read the Terms and Conditions (link to the GC) and accepted," says the buyer is bound by these Terms and agree to them.

Order II: Our offers are non-binding.

By placing an order to purchase goods on the Internet, the buyer makes a binding offer to conclude a sales contract.

The order confirmation will be sent via e-mail, this still does not constitute acceptance of the offer (An order confirmation does not constitute a binding acceptance by SHOETATION).

The purchase agreement is done when the ordered goods are delivered. Consumers: For transactions with consumers within the meaning of the Austrian Consumer Protection Act apply these general terms and conditions insofar as they do not conflict with mandatory applicable provisions of the Consumer Protection Act.

SHOETATION is able to not accept online orders. The decision is at the discretion of SHOETATION. If an online order is not running,  SHOETATION will tell the customer without delay.

SHOETATION reserves the right to send only small amounts. Should an item not be available in exceptional cases, you will be notified of it via e-mail.

III. Prices: a) All the online shop prices are inclusive of VAT, but do not include shipping and handling costs. Prices subject to change. Prices shown are before signing a contract in the basket and then within, the customer sends order confirmation. The amount is shown in Euros.

IV. Cancellation by law: a) We provide our customers, by law, the right to cancel the contract within 14 days of receipt of the goods (including Sundays and holidays).The revocation can be processed without giving reasons in writing by mail or letter to SHOETATION within the period to the address below. Items that do not meet your expectations, please send in the original packaging back to us. The goods should be sent in unused and resaleable as new condition and in original packaging. For items that are damaged by wear or the packaging is damaged, an appropriate charge is levied for the impairment or withheld.

The cost of returning goods shall be borne by the customer. (§ 5g Abs 2 KSchG). (§ 2 para 5g Consumer Protection Act).

Should the goods be returned freight collect, we are entitled to deduct a corresponding amount. After the 2 week period, the purchase will automatically take effect.

V. Conditions: a) Delivery is available by sending the purchased item to the address given by the buyer.

b) The shipping costs for standard shipping EUR 15.00 (in the ordering process with "standard shipping" marked);  Exceptions are deliveries by freight carrier or special transportation.

c) Any damage is on the acquisition of goods immediately signed by the shipper or carrier and compensation claims to be made on them.

d) Regardless of other agreements on transportation dispatch and delivery of the goods the risk of damage or loss, from the time of going to the customer in which the goods leave our premises. A delivery outside Austria last usually within a few days, usually starting in about 7 working days of delivery confirmation, but in any case within 30 days of order date.

Should we - for example due to the unavailability of the product - an order can not accept, or arise from a longer delivery time, we notify the customer immediately. Should the customer not agree with the extented transportation time to, he is entitled to cancel the contract.

VI.  Payment:
If SHOETATION you can pay as follows:

By pre-payment - the amount you pay to SHOETATION, account number: 52720000101, IBAN: at76 1200 0527 2000 0101, BIC: BKAUATWW;

By credit card - If paying by credit card, the bill is now using a secure server (SSL encryption) to the service provider OGONE invoice receipt-deductible and free of charges due.
If you pay with PayPal, they are redirected to the PayPal website, payment is due immediately.

VII. Retention of title: a) the goods are - until full payment - all our property. Disposals of our products during the duration of our retention of title are not allowed. If our goods are still available from the customer or is it re-sold, so our retention of title also extends to any purchase or use of claims for payment by the customer of any third party.

VIII Warranty and complaints: the goods supplied by us we make material for replacement within 2 years from date of shipment by us.  Unfit for work and the customer will not be replaced. Warranty claims are to be fulfilled by us according to our means of repair or replacement and, in cases where this is possible at our discretion, limited to repair or replace parts. To make use of the guarantee  the fulfillment of payment is necessary.
Excluded from warranty are any minor shortcomings. The buyer hasto report any defects in accordance with its commercial reprimand immediately complain to no later than one week after arrival of the goods by recorded delivery. If any shipping damage happens it is important to issue immediately a damage report (by mail, courier) is to cause. In recognition of the shortcomings we commit ourselves to return of the defective goods to be delivered to us in a reasonable period of defect-free replacement product. A claim by a customer is excluded for damages for any reason. If, in case of returning the goods, that the protest was made in error, we are entitled to charge not only the cost of shipping, but also an adequate remuneration for the audit. Replacement of an indirect or direct damages (consequential damages) is not granted. Returned goods will only be accepted if previously made an agreement on the withdrawal.

IX. Date loss: This occurs when a payment for more than eight days in arrears by, are therefore partial and installment payments of all installments due immediately. Date loss also entitles the seller to withdraw from the business.

X. Typographical errors: For any easier to negligence-based printing errors in our advertising materials and data errors in our store, we assume no liability. You can confirm your order then under the changed terms again. SHOETATION otherwise be entitled to withdraw from the contract.

XI. Of performance and jurisdiction: a) performance is deemed solely as agreed in Vienna. b) b) When ordered abroad by Austrian law shall apply. c) If the buyer is a consumer, the provisions of the Consumer Protection Act are to that extent our terms and conditions with mandatory provisions of the Consumer Protection Act in opposition..

XII. Language of the contract: the contract, all other information, customer service, data, information and complaint handling are offered generally in English.

XIII. Copyright: All messages, graphics and design of the web site of SHOETATION are intended for personal information of our customers. Use at your own risk. All data in this publication are protected under § 4 and § § 87a et seq Copyright Act. The reproduction, copying and printing of the entire website are permitted only for the purpose of ordering from SHOETATION. Any further processing, copying, distribution and / or public exceeds the normal use and represents a violation of copyright law

XIV Severability: Should any of these terms and conditions in whole or in part, be or become invalid or unenforceable, the validity of validity of the other conditions do not.
